KROLL ON BIWOTT – SHARES IN ‘GOVERNMENT OF KENYA LTD’

The Kenya Kroll Report alleged that Nicholas Biwott, “Owns shares in a company called the ‘Government of Kenya Ltd’’ together with ‘other officials’ of which are named as ‘Ex-President Moi, George Saitoti, Sally Kosgei, Chrysantus Okemo, Nicholas Biwott, Mark Bor, JK Musyimi and Mr. Deche’.

The Source is unclear how a company called ‘Government of Kenya Ltd’ could ever have been incorporated and has seen no evidence to indicate that such an entity was ever incorporated, or could have been.

The Kenyan Registration of Business Names Act 1951, Chapter 499, section 17 states clearly that:

The Registrar shall refuse to register, or, in the case of an application under section 9, to register a change of business name of, any firm, individual or corporation, or proposing to carry on business under a business name – … (b) which includes any of the words “Presidential”, “Government”, “Municipal” or any other word which imports or suggests that the business enjoys the patronage of the President or imports any connection with the Government or with any municipality or other local authority’.
